Membership Rules
MEMBERSHIP RULES
1. Definitions
“Account” means the Club’s bank account detailed on the Subscription schedule,
“AGM” means the Annual General Meeting of the Club as described in paragraph 10;
“Club” means the not-for-profit organisation for the promotion, organisation and co-ordination of activities of a recreational, sporting and social nature known as BMC Sports Club, Boseja, Maun, as registered with the Botswana Registrar of Societies and as governed by the Constitution;
“Committee” means the office bearers and other members of the committee of the Club which shall have the powers and transact the business of the Club as set out in the Constitution;
“Constitution” means the governing document of the Club as registered with the Registrar of Societies and which shall be made available to Members on request;
“Corporate Member” means a company, institution or organization wishing to include registered employees of the company as members of the BMC Sports Club.
"Family member" means 2 adults legally committed and their children. Children under family membership are considered individuals who have not yet reached their 19th birthday.
“Member” means a member of the Club under one of the Membership categories, who has filled out the membership application form.
“Membership” Senior, Junior, Country, Corporate and Family Members as described in the current Subscription information;
“Paid Up Member” Means a member who has both filled in the applicable years membership form and paid applicable fees for the membership period.
“Rules” means the rules, terms and conditions of membership of the Club being these rules, the Subscription schedule, the Constitution and such rules and regulations of the Club as may be issued from time to time in accordance with the Constitution;
“Special General Meetings” means meetings requisitioned in writing by not less than 50% of the Members in accordance with the Constitution;
“Subscription” means fees for Membership which amounts vary according to the type of Membership and are as per the current Subscription information; and
“Visitor” means any visitor premises who is not a Member, who has paid the applicable visitors fee, completed the registry and agrees to follow the club rules and who is accompanied by an existing member of the Club.
2. Membership Application Process
2.1 Candidates for admission as a Member shall be submitted by electronic submissions or hard copy submissions handed in directly at the bar. Every application for Membership shall be submitted to the Committee who shall be entitled to accept or reject any candidate without giving any reasons and whose decision shall be final.
2.2 All applications for Membership shall be on the completed and signed prescribed application form and accompanied by the Subscription. Corporate Members must supply the Club with applications forms completed by each individual Member under the corporate Membership.
2.3 All members who complete the membership form shall automatically become members of the club for a period of 3 months after the date of submission. Should the member after 3 months not be paid up the membership will lapse and the member wil then be required to pay the daily visitors fee or balance of fees up front.
3. Key
3.1 A Member shall be given a key to access the Club premises’ gate and squash courts building upon payment of sixty five pula (BWP75) which is in addition to the Subscription.
3.2 The key remains the property of the Club and a Member must return the key within one week of the end of Membership.
4. Subscriptions
4.1 Subscriptions are paid annually for the period 1st January to 31st December.
4.2 Membership will not commence until the completed and signed application form is received and approved by the Committee in accordance with paragraph 2 above and once the Subscription has been received in the Account and proof of payment provided to the Committee.
4.3 Members listed under corporate membership, may “upgrade” their membership to include family members, as per the family membership description, by paying half of the membership due. This is only applicable to corporate members and their children.
5. Resignation
5.1 A Member may at any time, by giving notice in writing to the Club secretary, resign their Membership, but shall continue to be liable for any Subscription due and unpaid at the date of resignation.
5.2 There shall be no refund of Subscription when a resignation is tendered part way through a year.
6. Conduct and Expulsion
In the event of unbecoming conduct or other wrongdoing by a Member, Membership may be terminated in accordance with the Constitution.
7. Refreshments
No food, drink or liquor may be consumed on Club premises except those bought from the Club.
8. Care of the Club Premises and Club Rules
8.1 Members agree:
8.1.1 take care of the Club premises during use of the premises;
8.1.2 turn off lights and fans;
8.1.3 slacken the tennis nets after use;
8.1.4 lock the squash courts and the front gate when they leave;
8.1.5 take their litter home with them; and
8.1.6 be bound by the Constitution and Club bye-laws in every respect.
8.2 Members acknowledge and agree that NO CREDIT shall be given at the Club Bar.
8.3 Members acknowledge and agree that they do not have the right to host their own events at the Club and may not do so except with the prior written permission of the Committee.
8.4 Members acknowledge and agree that they shall not coach players for financial gain without separate agreement with and payment to the Club.
9. Rights of Membership
Membership does not and shall not give any Member any right, title, interest, claim or demand in or to any monies, profits, assets or property of the Club. Membership only confers on Members the right and privileges of entering in and upon the grounds and buildings of the Club and of using and enjoying the facilities of the Club, subject to the Rules and such other reasonable restrictions as the Committee may impose from time to time.
10. Club Meetings
10.1 The Committee will meet once every calendar month as per the Constitution.
10.2 The AGM will be held on or before the end of April each year. Notices of the AGM will be displayed as per the Constitution and business of the AGM conducted in accordance with the Constitution.
10.3 Members may call Special General Meetings in accordance with the Constitution.
11. Visitors
Any Visitor may only enter the Club premises by invitation of a Member and that Member must ensure that the Visitor signs the register and pays the Visitor’s day rate as per the Subscription information and shall be responsible for providing the Committee with a signed contact form and indemnity for the Visitor.
12. Booking Courts
All memberships upon registration will receive website link to register for the online bookings, where an online registration will be required to book the court: www.maunsportsclub.com. Only members who have completed the membership registration form will be allowed access to book the courts.
13. Liability and Indemnity
13.1 In consideration of being permitted to enter the Club’s premises and/or being granted access to the Club’s facilities, amenities, and services the Member hereby releases, waives and discharges the Club, including its Committee from, and agrees and covenants not to sue the Club nor Committee for, any claim, liability, or demand of any kind or on account of any personal injury, temporary or permanent disability, death, property damage, or other damages, whether caused by the negligence of Committee or Club or otherwise, resulting from or in any way associated with the Member’s entry on the Club’s premises or use of the Club’s facilities, amenities, services, or participation in any of the activities at the Club whether exercising or not, or whether on the premises or not. Further, the Member agrees and covenants to indemnify the Committee and Club for, and hold them harmless, from any such claims, liabilities or demands.
13.2 The Member further hereby voluntarily assumes all risks of personal injury, including temporary or permanent disability or death, property damage, economic losses, and/or other damages to the Member resulting from or in any way associated with his/her entry on the Club’s premises or use of the facilities, amenities, services, or participation in any of the activities at the Club whether exercising or not, or whether on the premises or not.
13.3 The Member acknowledges and agrees that paragraph 13 is intended to be, and is, a complete release of any responsibility of the Committee and Club for personal injuries and/or temporary or permanent disability or death and/or property loss/damage sustained by the Member while on the Club’s premises or while using the Club’s facilities, amenities, services or while participating in any of the activities at the Club, whether exercising or not, or whether on the premises or not; and the Member further acknowledges and agrees that it is specifically intended to and does include release, waiver, assumption of risk and indemnity as to premises liability claims such as (by example, not limitation) slip & falls and/or trip & falls at the Club premises.
13.4 The Member hereby grants the Club, the irrevocable and unrestricted right and permission to use, re-use, publish, and re-publish photographic portraits or pictures of the Member, for illustration, promotion, art editorial advertising trade or any other purpose whatsoever.
14. PERSONAL INFORMATION:
The Member consents to the Committee and Club collecting, retaining and using personal information including without limitation the Member’s name, contact details, omang/ ID for submission to the Registrar of Societies as required by law and for marketing and other Club purposes subject to the Data Protection Act 2018.
